TERMS AND CODITIONS OF THE SERVICE

 

GENERAL TERMS AND CONDITIONS OF SALE.

 

1. Scope.

1.1.  These general terms and conditions of sale govern the offer and sale of women's clothing (hereinafter referred to as the "Products") on the www.BESIONIA.com website (hereinafter referred to as the "Website").

1.3. Access to the Products of the Site is allowed to consumer users, provided that they are over 18 years of age. "Consumer", pursuant to Article 3 paragraph 1 lett. A) of Legislative Decree no. 06 of 09.2005.206 (hereinafter referred to as the Consumer Code), means the natural person who acts for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out.

1.4. The sale of Products through the Site constitutes a distance contract governed by art. 45 et seq. of the Consumer Code and Legislative Decree 09.04.2003 n.70 (containing the regulation of electronic commerce).

1.5.  With regard to sales made on the Site, the parties agree that the same will be governed in full and exclusively by these General Terms and Conditions of Sale.

1.6. These General Terms and Conditions of Sale can be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005 as amended by Legislative Decree 21/2014.

 

2. Registration. Identification.

2.1. Access to browsing the Site and the purchase of Products is allowed without registration for all users.
2.2.The information or personal data provided by the user will be processed in accordance with the Data Protection Policies. By using the Site, the user authorizes the processing of such information necessary to proceed with the purchase of the Products and declares that all the information and/or personal data provided are true.

3. How to purchase.

3.1. In order to place an Order, the user must fill in the Billing Data in its entirety, possibly indicating a different address for the shipment of the goods, taking care to have entered the correct house number and having carefully viewed and accepted the General Conditions of Sale, and send the same by clicking on the "Continue on PayPal" button. If the payment is made by credit card, the user must carry out the procedure described above by clicking on the "Place Order" button.
3.2. The receipt of the Order is confirmed by the Seller by means of an e-mail reply (Order Confirmation), sent to the e-mail address provided by the user. The confirmation message will briefly report the conditions of purchase, as required by applicable legislation, the data entered in the Order by the user.

 

4. Terms and methods of payment.

4.1. The user must provide for the advance payment of the product subject to the Order, constituting the non-payment as an express reason for termination of this contract.
4.2. Payment can be made: with PayPal payment system according to the specific methods of the same. The amount of the transaction will be charged directly by PayPal. The Seller cannot be held responsible for any delay or omission in crediting the amount or in refunding the sums paid, for which the user must contact PayPal directly with Visa/Mastercard/America Express credit cards. The information will never be used by the seller except to complete the procedures relating to the purchase and to issue the relevant refunds in the event of any return of the products or following the exercise of the of the right of withdrawal, or if it is necessary to prevent or report the commission of crimes to the police

 

5. Prices, shipping and delivery terms.

5.1. The selling prices of the products are expressed in US Dollar.  For all destinations, duties, taxes and duties will remain the responsibility of the User.Shipping costs to customers are included in the price shown in the invoice. But the User bear the shipping cost if they return the goods.Meanwhile, in order to ensure that your shipment is cleared through customs, to provide all necessary information and/or settle the relevant taxes. If the shipment is not cleared through customs, it will be returned to our warehouse, with the user being charged the higher costs that will be deducted from the refund due.
5.2. Delivery costs are in any case indicated in the order summary before proceeding with payment.
5.3. BESIONIA ships throughout Italy, within the EU and to non-EU countries; Delivery is made to the address provided at the time of purchase.
5.4.The products will be shipped made within 2 working days from our warehouse.
5.5. If it is not possible to make the delivery, the order will be sent to the warehouse and in this case an email will be sent to the user which will specify the place where the order is located and the methods by which to agree on a new delivery.
5.6.  The delivery deadline is deemed to have been fulfilled and respected with the delivery of the Product to the third-party carrier.
5.7.  Upon delivery of the Product, it will be the User's obligation to immediately check that the package is intact and undamaged and correctly closed and sealed. In the event of damage to the goods presumably caused during transport, the User may refuse delivery and immediately notify who will make the necessary objections to the courier in charge, providing for a new shipment once the disputed goods have been received.
5.8. At the time of delivery, the User is also required to check the integrity of the Product and to report any defects in the delivered Product within 7 (seven) days of delivery. Met reserves the right to request photographic evidence before authorizing the return for defective goods.

 

6.Right of withdrawal.

6.1. The User has the right to withdraw from the contract without giving any reason and without any penalty within 14 (fourteen) working days from the date of receipt of the products.
6.2. To exercise the right of withdrawal, the User must send an email to the address info@Besionia.com and with the subject "exercise of the right of withdrawal".
6.3. n the event of withdrawal, the User, within 14 working days from the day on which the withdrawal is communicated, must return the products to MovimodaLima Warehouse,2F NO.5 Airport Industial Zone,New Market Zhouchun, Nanhai Foushan, GD, China 528000The Products must be returned intact in their original packaging (envelopes and packages), the Products must not have been washed, damaged and/or soiled and/or altered, the identification tag must still be attached to the product.
6.4. The shipping costs, and any customs charges if any, for the return of the Product will be the sole responsibility of the User. The shipment, until the certificate of receipt at the place indicated by Met, is under the full responsibility of the User, therefore BESIONIA will not be liable in any way for damage, theft, loss occurred during or in any case depending on the return shipment.
6.5. Withdrawal not exercised according to the terms and procedures described above determines the illegitimacy of the unilateral termination and, consequently, the non-obligation of reimbursement.

 

7.Refund.

7.1. The Vendor may withhold the refund until receipt of the returned Product.
7.2. After the return of the Product, the Seller shall carry out the necessary checks that the Product complies with the conditions and terms set out in the General Terms and Conditions of Sale. In the event that the checks are positively concluded, the Vendor will send the User, via e-mail, the relevant confirmation of acceptance of the returned Product.
7.3. The refund will be activated no later than 14 days after the communication of acceptance of the return, using the same means of payment used by the User for the initial transaction. In any case, the User will not incur any costs as a consequence of such reimbursement.
